The Californian Supreme Court is to rule later this year on whether such a ban would be legitimate.
The UK has a mandatory system for certain types of video games depending upon the content. Games featuring sex or violence must be submitted for classification by the British Board of Film Classification (BBFC) in accordance with the Video Recordings Act 1984. The role of digital and interactive media was elaborated in the Criminal Justice & Public Order Act 1994, which introduced a number of new tests to the classification process, including a specific requirement to consider the ‘harm’ that the work may cause a potential viewer.
Video games remain generally exempt under the Video Recordings Act 1984 (VRA). However, the exemption will not apply if that game depicts:
- may encourage criminal activity (or other “matters of concern”); and/or

The VRA was introduced at a time when games could not hope to rival the imagery of movies and films, but given the increasing visual fidelity of current and next generation videogames and the considerable crossover of interactive and traditional media entertainment, this exemption is of increasingly little value.
The attitude towards classification in the games industry has shifted over time and as a result, many publishers submit each and every new game to the BBFC to ensure the game has been classified before publication.
Following the arrival of the Digital Economy Act, legal powers have been granted to the PEGI (Pan-European Game Information) rating system with effect from 1 April 2011 and PEGI will become the sole classifier for video games in the UK. Any retailer who sells games after that date to anyone younger than the age certificate on the front of a game’s box is liable to prosecution.
In addition to the UK’s own mandatory age classification scheme, the PEGI scheme is a voluntary age suitability scheme aimed primarily at advising parents. The PEGI scheme currently covers sixteen countries within Europe, with Germany being the most notable absentee, as it relies upon its own compulsory classification procedure. Any submissions made under the PEGI scheme will be required to consult a checklist of the type of content that is likely to require mandatory classification. Whilst the checklist on the application form should not be taken as a complete summary, it does provide further guidance of the type of content to be wary of. It should be noted however that the age classifications under the BBFC and PEGI schemes do not necessarily match.
The law in relation to what is illegal is judged according to whether the material in question is legally obscene. Fortunately, whilst the Obscene Publications Acts were crafted in the early 1960’s, the test is judged according to the contemporary standards. The test is simply whether the effect of the material (considered as a whole) is “such as to deprave and corrupt persons“. There is no set definition; it is not enough that the publication shock or disgust, it must have a morally debasing, corrupting effect upon the viewer.
The requirement that the material be taken as a whole, rather than in relation to a specific item of content, considerably reduces the scope of the law in this area. In practice, the law of obscenity is rarely used, as mandatory classification has for the most part dealt with this issue. The key factor is the intended audience for the material. In light of this, publishers may wish to consider the material which is contained on a games website, given the difficulties of restricting access to a particular age group over the internet.
The BBFC Ratings
Given the generally balanced approach to censorship in the UK, the barrier as to what is and is not permissible within a video game is largely a decision for the publisher, depending on the market they are aiming for. The increasingly mature audience of the gaming market means that publishers may feel they can afford to release games that are restricted to the over 18 audience without taking a major hit in sales, as the Grand Theft Auto series ably demonstrates. Given that the fundamental basis of the age classification schemes is the protection of children, it follows that PG, 12 and 15 rated works will require greater scrutiny on the part of the developer/publisher to ensure that the game meets the required classification. Looking at the BBFC’s most recent decisions this is likely to affect magazine publishers who may bundle a mixture of demos and videos on cover mounted disks and wish to sell the magazine to the broadest audience available.
A comparison of “Psychonauts” – rated PG, “From Russia with Love” – rated 12 and “Resident Evil 4” – rated 15, shows that even strong violence may not automatically result in an 18 certificate. When I was a child, my family had a cottage on a small lake in Northern Minnesota. Of course, Scrabble was always a favorite but, as the youngest, I was a little handicapped by my vocabulary. At the time, I didn’t know about short words like Qi. Today I play Scrabble every day online with friends and use these words regularly although I have to admit that I still have no idea what they mean.
In college, I was introduced to Bridge. I watched friends playing; listening to their bids and studying their plays. When I met Barry, my husband-to-be, I had only played a few times. After we were engaged, he and I were invited to dinner and a bridge game at one of his married friend’s houses. I was nervous and felt like a kid; these couples were four or five years older than me and actually lived in houses, rather than dormitories. I was second from last, with only a few more points than a ninety-year old woman who had dementia. The game was only two hours but it felt like eight. By the time I got home, I had a terrible headache. When Barry walked in the door, I was lying on the couch, an ice pack on my head and a glass of wine and bottle of aspirin on the table beside me.
When our children came along, we both spent hours playing children’s games such as Candy Land, Old Maid, Go Fish and Chutes and Ladders. Although those games disappeared as our children grew up, our game closet is now restocked with all of them, waiting for our granddaughter’s next visit. I’m finding it more fun playing the games this time around than I did when our children were young. I’m quite sure the reason for this is because we can enjoy playing with our grandchild without the anxieties that accompanied raising our own children. Grandchildren are simply fun!
With the advent of computers, we can also play a lot of games online. As I mentioned before, I play at least ten games of Scrabble with friends and family but these move slowly with only one move by each player in a day. In addition, I am addicted to the Microsoft Solitaire Collection which includes a daily challenge in five different solitaire games. You collect points which grow daily until (hopefully) you reach the gold bell by the end of the month when the scoring starts over. If you miss a few days, you get behind on your games. Since we have lived in Florida, we have been introduced to two new games that we play with friends. The first is Rummikub, a board game that is a lot like 500 rummy. Barry and I play with three friends every couple of months and we usually lose. One friend has been playing this game for years with a group in her home town. They play for money, a penny a point and she would like us to do this also. I’d be willing if either Barry or I won once in a while but at the rate we’re going now, that isn’t going to happen anytime soon.
The other game we play with friends in our neighborhood is Mexican Train, a dominoes game. The strategy is fun but the best part of this game is pushing the button in the middle of the plastic train which emits a loud, “Choo cho, choo cho.” Of course, to be allowed to push the button you have to first win the game and, unfortunately that doesn’t happen to me very often. So occasionally I cheat and push the button for fun.

Treasure Madness is another typical Treasure hunting game that recently been introduce to the Facebook community. Like the game Treasure Isle by Zynga, this game is based on treasure hunting and explorations. However, you must be asking what makes this game different from any other treasure hunting game out there?
First off we look at the interface of Treasure Madness. The thing here is, this game is not fully base on Flash alone. I do notice that some part of the game is made out of web interface. This is kind of unique with the mixture of both worlds. Health bars and inventory menus are located on the right side of the screen and it is not part of flash, rather it is web based here. On the centre of the screen is where you do your main interaction.
The Game first introduce you to the welcome screen and as soon as you click PLAY, you will be display with the loading screen of the Bi-Plane flying to a unknown island. This is where you game starts. Tutorial in this game is simple and rather short.
Once you reach the island you will be instructed to DIG the grown you walk on. From there it is really depends on your luck to see what you can find below. Funny part of the game here is if you do not find anything the your character will shout out loud in strange symbols (You might get the joke to this if you read a lot of comics) and if you do find something a new screen will pop up and provide you with a challenge. This is where this game truly shines compared to Treasure Isle.
Each finding will provide you with a mini-game which is randomly generated and provide players with a chance to play games like Fruittle, Pearls Mania and a few others more. Each games plays differently and this allow players to actually play the game without getting bored of the same old thing over and over again.
The mini-games are easy to play and most will come with a simple instruction on how the game works. After a few hours into the game, I really love how the developers do with all the mini-games as some is very addictive and easy to master for all ages. Once you completed the mini-game a reward will be provided to the player. However if the player somehow lose during the mini-game, then no reward is offer. Somehow this game provides player with challenge to always try to beat the mini-game to gain extra bonus items.
The game itself is not only about digging the ground you walk on, you will also have to chop down trees, vines and also do a little mining operations. However most equipment need to be purchase and it does not come cheap. So for the first few round, players will be limited to digging the earth a bit.
Something I do notice is that once you finish a map, player will then have to purchase a new map in order to continue their treasure hunting quest. This is where a bit of resource management comes in as you need to plan a bit on what to buy and what not. Nothing is really serious on this part of the game play.
Another thing we look at is the inventory system. The inventory system can be access at anytime and the right side of the screen. Mainly the only thing the players need to worry about is their health as it is used to help player continue their hunting. Best part, fruits or health regeneration pack is easily come back and the health refill counter is also limited to 35 seconds. Not really the best graphic you can find in Facebook gaming as some of the texture in the game is rather simple and plain. But this is not to say this is an ugly game to begin with. This game does has its shines in the graphic department.
I do not really comment much on the sound as I do not really recall having any music. Sound FX and rather plain, but for this sort of game it is rather suitable as you do not really need to hear a lot from the game itself.
